As with all physical activities, there is always the unforeseen risk of an injury. While the Instructor takes all care, they cannot be responsible for any injuries incurred while participating in their classes.
Please ensure that you communicate with your instructor any conditions that may prevent you from participating fully in the activities. Prior to class please let the Peak Physiology Staff know if you will have children with you.
If so, please note that it is your responsibility to maintain their safety at all times, with no disruption to class and its participants. You can be sure that our team is fully qualified and also hold a Senior First Aid and insurance. Peak Physiology’s promise to you is to deliver a professional, safe, effective programme, & most of all a happy & fun place to be. This is your time! Don’t worry about what others are doing around you as we are all at various levels. Time is precious and so are you, so please treat yourself, all participants and your instructor with respect.

Our studio holds limited spaces, and many of our Classes/Appointments sell out. For this reason, we request that you cancel at least 4 hours before your scheduled Class/Appointment. This will allow us to offer your spot to another person.To cancel you will have to visit our website, www.peakphysiology.com.au. If you do not cancel with at least 3 hours notice, you will lose any payments you have already made.
If you’re wanting to cancel your membership at the 6 months you will need to provide 2 weeks notice before. This membership may be cancelled by providing written notice, in person, at Peak Physiology or by email [email protected] The membership will be ongoing after the 6 months. If the membership contract is cancelled prior to the contract expiration date, the Member agrees to pay a cancellation fee of the pay out that is left of the contract. If the Member must cancel this studio membership contract due to military service or relocation to an area more than 45 kilometers from a Peak Physiology facility, the Member may cancel without paying the cancellation fee.
If the member must cancel due to illness or unfit to finish the contract, a letter from the doctor must be provided to say you are unfit to finish the contract.The Member hereby agrees to abide by all posted safety guidelines and regulations while using Peak Physiology facilities and equipment. Membership Fees will be debited from the member’s account, using their given bank debit/credit card, on or around their join date each month, for the minimum 2 weeks term from the term start date. Members who have chosen the 6 MONTH CONTRACT payment option will NOT have a cancel option until after the 5.5 month, after that time they will have the option to cancel at any time with 2 weeks notice. Members who have chosen the NO CONTRACT payment option can cancel or freeze their agreement at any time with 2 weeks notice, and up to 4 weeks of freeze time. Members are required to keep their account in funds to meet these payments. In the event of the failure to pay the weekly membership fee you will be a dishounor fee of $14.80, missed payments will be re-submitted for payment in 2 days by EziDebit. Peak Physiology reserves the right to cancel membership if payment is not received. Access to the facility will be denied until said payment is received and if payment is not received, and cancellation occurs, the registration fee becomes applicable again on re-joining. These arrears of fees must be paid by Credit or Debit card online using the Member Area. Failure to meet direct debit fee – In the event of the failure to pay the weekly direct debit fee, you will first be notified that your membership has been temporarily stopped until the balance is paid. The club reserves the right to vary the opening hours as considered necessary for the proper operation of the centre. Guests of members are welcome to use the facilities & services of the club, by purchasing a casual visit.
Safety & Hygiene
Throughout the course of your membership,classes or appointments with Peak Physiology regular health and medical screening should be sought from your General Practitioner.
It is necessary that all members and guests of the club wear appropriate, clean attire and foot wear when using the studio..
If you feel dizzy, faint, unwell or feel any unusual pain then you must stop exercising and inform a member of staff immediately.
Members cannot train in the club without a hand towel. In the interest of hygiene members must wipe down each piece of equipment after use.
Studio users are advised to inform the instructor of any injuries, pains or concerns prior to the class starting.
All memberships are subject to a 48 hour cooling-off period (which starts from the time that the membership application is received at the front counter or via website)
To terminate a membership within the cooling-off period, members must notify Peak Physiology in writing that they wish to exercise their right to cool off. The written notification can be submitted in person at the front counter, or via email to [email protected] Physiology.com.au If submitted via email, the date and time received will be taken from the incoming email. If submitted in person, the date and time that the form is handed into the front desk must be recorded on the written request.
If you cancel during the cooling off period, any amount paid will be refunded less a charge for use of the studio which will be calculated based on the casual attendance rate.
A member agrees to be a member of Peak Physiology for the full period of time for which they are signing up.
No refunds after the 48 hour cooling-off period will be accepted without the grounds of extenuating circumstances that will disallow the member to continue use of their membership. For example, serious illness or injury, or moving substantially further away from Peak Physiology.
A minimum of 2 weeks written notice is required to cancel a membership. You can continue to use your membership during the notification period.
If a refund is requested, it will be subject to a $25 cancellation fee. Cancellations and refunds are processed at the end of the notice period.
Peak Physiology appreciates the importance of protecting your personal information and recognises the trust placed in us when you supply your personal information to us.
Peak Physiology will control the collection, security, quality, use and disclosure of personal information in accordance with the Privacy Act 1988 (Cth) (Privacy Act).

How Peak Physiology collects personal information
As far as possible, Peak Physiology will collect your personal information directly from you unless it is unreasonable or impracticable to do so. If Peak Physiology collects information about you from someone else, Peak Physiology will, whenever reasonably possible, make you aware that Peak Physiology has done this and circumstances of that collection.
Collection from use of website or mobile app
If you use our website or mobile app, we may utilise ‘cookies’ and any other technologies, which enable us to monitor traffic patterns and to serve you more efficiently if you revisit our website / mobile app. A cookie or similar technology does not identify you personally but may identify your internet service provider, computer or mobile device.
