Liability Waiver

As with all physical activities, there is always the unforeseen risk of an injury. While the Instructor takes all care, they cannot be responsible for any injuries incurred while participating in their classes. Please ensure that you communicate with your instructor any conditions that may prevent you from participating fully in the activities. Prior to class please let the Peak Physiology Staff know if you will have children with you. If so, please note that it is your responsibility to maintain their safety at all times, with no disruption to class and its participants. You can be sure that our team is fully qualified and also hold a Senior First Aid and insurance. Peak Physiology’s promise to you is to deliver a professional, safe, effective programme, & most of all a happy & fun place to be. This is your time! Don’t worry about what others are doing around you as we are all at various levels. Time is precious and so are you, so please treat yourself, all participants and your instructor with respect.

Cancellation Policy

Our studio holds limited spaces, and many of our Classes/Appointments sell out. For this reason, we request that you cancel at least 4 hours before your scheduled Class/Appointment. This will allow us to offer your spot to another person.To cancel you will have to visit our website, www.peakphysiology.com.au. If you do not cancel with at least 3 hours notice, you will lose any payments you have already made.



Members

If you’re wanting to cancel your membership at the 6 months you will need to provide 2 weeks notice before. This membership may be cancelled by providing written notice, in person, at Peak Physiology or by email [email protected] The membership will be ongoing after the 6 months. If the membership contract is cancelled prior to the contract expiration date, the Member agrees to pay a cancellation fee of the pay out that is left of the contract. If the Member must cancel this studio membership contract due to military service or relocation to an area more than 45 kilometers from a Peak Physiology facility, the Member may cancel without paying the cancellation fee.

If the member must cancel due to illness or unfit to finish the contract, a letter from the doctor must be provided to say you are unfit to finish the contract.The Member hereby agrees to abide by all posted safety guidelines and regulations while using Peak Physiology facilities and equipment. Membership Fees will be debited from the member’s account, using their given bank debit/credit card, on or around their join date each month, for the minimum 2 weeks term from the term start date. Members who have chosen the 6 MONTH CONTRACT payment option will NOT have a cancel option until after the 5.5 month, after that time they will have the option to cancel at any time with 2 weeks notice. Members who have chosen the NO CONTRACT payment option can cancel or freeze their agreement at any time with 2 weeks notice, and up to 4 weeks of freeze time. Members are required to keep their account in funds to meet these payments. In the event of the failure to pay the weekly membership fee you will be a dishounor fee of $14.80, missed payments will be re-submitted for payment in 2 days by EziDebit. Peak Physiology reserves the right to cancel membership if payment is not received. Access to the facility will be denied until said payment is received and if payment is not received, and cancellation occurs, the registration fee becomes applicable again on re-joining. These arrears of fees must be paid by Credit or Debit card online using the Member Area. Failure to meet direct debit fee – In the event of the failure to pay the weekly direct debit fee, you will first be notified that your membership has been temporarily stopped until the balance is paid. The club reserves the right to vary the opening hours as considered necessary for the proper operation of the centre. Guests of members are welcome to use the facilities & services of the club, by purchasing a casual visit.

Safety & Hygiene

Throughout the course of your membership,classes or appointments with Peak Physiology regular health and medical screening should be sought from your General Practitioner.

It is necessary that all members and guests of the club wear appropriate, clean attire and foot wear when using the studio..

If you feel dizzy, faint, unwell or feel any unusual pain then you must stop exercising and inform a member of staff immediately.

Members cannot train in the club without a hand towel. In the interest of hygiene members must wipe down each piece of equipment after use.

Studio users are advised to inform the instructor of any injuries, pains or concerns prior to the class starting.

Return/Refund Policy

All memberships are subject to a 48 hour cooling-off period (which starts from the time that the membership application is received at the front counter or via website)

To terminate a membership within the cooling-off period, members must notify Peak Physiology in writing that they wish to exercise their right to cool off. The written notification can be submitted in person at the front counter, or via email to [email protected] Physiology.com.au  If submitted via email, the date and time received will be taken from the incoming email. If submitted in person, the date and time that the form is handed into the front desk must be recorded on the written request.

If you cancel during the cooling off period, any amount paid will be refunded less a charge for use of the studio which will be calculated based on the casual attendance rate.

A member agrees to be a member of Peak Physiology for the full period of time for which they are signing up.

No refunds after the 48 hour cooling-off period will be accepted without the grounds of extenuating circumstances that will disallow the member to continue use of their membership. For example, serious illness or injury, or moving substantially further away from Peak Physiology. 

A minimum of 2 weeks written notice is required to cancel a membership. You can continue to use your membership during the notification period.

If a refund is requested, it will be subject to a $25 cancellation fee. Cancellations and refunds are processed at the end of the notice period.

Privacy Policy

Peak Physiology appreciates the importance of protecting your personal information and recognises the trust placed in us when you supply your personal information to us.

Peak Physiology will control the collection, security, quality, use and disclosure of personal information in accordance with the Privacy Act 1988 (Cth) (Privacy Act).

This Privacy Policy explains in general terms how Peak Physiology protects the privacy of your personal information under the Australian Privacy Principles.

The expression ‘personal information’ is defined in the Privacy Acts as information or an opinion (including information or an opinion forming part of a database), whether true or not, and whether recorded in a material form or not, about an individual whose identity is apparent, or can reasonably be ascertained, from the information or opinion.

The kinds of personal information that we collect and hold about you depends on the transactions you undertake with us.

Insurance details (e.g. type of insurance and expiration date)

qualification details (e.g. Certificate III in Fitness)

other information relevant to the fitness profession that may be of interest to Peak Physiology

your internet service provider, computer or mobile device when use of our website or mobile app and you have enabled ‘cookies’, ‘web beacons’ and/or other technologies

Typical situations when Fitness Australia will collect personal information from you, is if you:

apply to join Peak Physiology as a member or register as an exercise professional

register with us for continuing professional development activities

subscribe to our newsletters, magazines or other publications

register or renew through the website

register for an event

purchase a product

use our website or mobile app

How Peak Physiology collects personal information

As far as possible, Peak Physiology will collect your personal information directly from you unless it is unreasonable or impracticable to do so. If Peak Physiology collects information about you from someone else, Peak Physiology will, whenever reasonably possible, make you aware that Peak Physiology has done this and circumstances of that collection.

Collection from use of website or mobile app

If you use our website or mobile app, we may utilise ‘cookies’ and any other technologies, which enable us to monitor traffic patterns and to serve you more efficiently if you revisit our website / mobile app. A cookie or similar technology does not identify you personally but may identify your internet service provider, computer or mobile device. You can set your browser or mobile device to notify you when you receive a cookie or web beacon and this will provide you with an opportunity to either accept or reject it in each instance.

Generally, the purpose of collection and holding personal information, and the minimum information you need to provide, will be conveyed to you at the time of collection.

If we collect sensitive information about you, we will only do so with your consent, unless consent is not required by law. Sensitive information is defined in the Privacy Act and includes information about your membership in a professional association such as Peak Physiology, health information and race origin.

Purpose of collection, storage, use and disclosure of personal information

The purposes of collecting, storing, using and disclosing your personal information may be to:

verify your identity

fulfil our functions as the peak body of the fitness industry

provide the products and services you have requested

administer and manage service offerings, including charging, billing and collecting debts

maintain registration and membership records

gain an understanding of your information and communication needs to provide you with a better service

provide access to information about current and future services and benefits

conduct research surveys and consultation to identify and analyse the ongoing needs of members and the industry

handle complaints about members or registrants

handle and conduct disciplinary proceedings on members

tell you about products and services that may be of interest to you

Direct marketing

We may use or disclose your personal information for the purpose of direct marketing. That is, to promote our products or services or those of third parties.

You expressly consent to the use or disclosure of your personal information for direct marketing purposes. You also expressly consent for Peak Physiology to disclose your personal information to our business partners or other third party providers to facilitate their sending direct marketing communications to you.

You may ask us to identify the source of the personal information that we use or disclose for direct marketing purposes. You can do this at any time by contacting us via the details set out at the end of this Privacy Policy.

If at any time you do not wish to receive any further direct marketing communications whether from us or from third parties, you can ask us not to send you any further direct marketing communications and not to disclose your personal information to third parties for that purpose. You can do this at any time by using the “unsubscribe” facility included in a prominent statement in the direct marketing communications or by contacting us via the details set out at the end of this Privacy Policy.

Other than the above, Peak Physiology will not disclose your personal information without your consent unless disclosure is either necessary to lessen or prevent a serious threat to the life, health or safety, authorised or required by law, reasonably necessary to enforce the law or necessary to investigate a suspected unlawful activity or serious misconduct.
